The Definitive Guide to Buying a Condo in Arlington VA

This guide is meant to inform and educate on all things condo. There are so many people who lack clarity about what a condominium is or are totally misinformed. It is not unusual to hear a comment such as "I am not interested in a condo because of all those fees”.

Yes, condos do come with fees. But have you considered the why and the what surrounding those fees? A fee by any other name Is still a fee. So if you have a home, one could say you are paying "fees” when you carry out maintenance activities such as replacing the roof, heating and air equipment, painting etc.? Couldn’t they? Are there costs associated with keeping up your beautiful lawn and gardens, removing snow and trash? 

This guide goes a long way to alleviate misunderstandings, offer some food for thought and insight and definitely a wealth of information which I hope you will find useful.

WHAT IS A CONDOMINIUM (CONDO)?

A condo is a category of housing recognizable by the fact that it is part of a larger building which looks like a rental apartment. That is, each unit is attached to another and spaces outside of the individual unit, e.g. corridors and elevators are called "common areas”.

So what makes it a condo and not a rental apartment? Simply, because you are allowed to buy the space between the walls giving you a "condo” ownership in the particular building. The building would have been registered as such (a "condominium") under the Virginia Condominium Act which contains rules and regulations by which the condominium through its owners’ association must abide, in addition to the Covenants, Conditions and Restrictions document.

Different states have their own Condominium Acts.

WHAT IS THE DIFFERENCE BETWEEN A CONDO & A COOPERATIVE (CO-OP)?

Many people have never heard of cooperatives (co-ops). They look exactly like condos, but are totally different animals. It is not my intention to deal with this type of residence at this time; rather I just want to alert you to be aware that they exist, with Virginia having a few buildings. DC has quite a few co-ops as well and pretty much all the condo-like buildings in New York are actually cooperatives. 

A few things to note regarding co-ops. You cannot own a co-op. You purchase and own shares in the cooperative if you are approved by the existing partners after clearing strict “ownership” requirements. Very few financial institutions offer loans for co-ops in Virginia. 

If you are searching for condos online, make sure you are indeed looking at condos and not co-ops.





WHAT IS THE DIFFERENCE BETWEEN A CONDO & A REGULAR HOUSE?

The difference between a condominium and a regular Arlington home for sale is huge. Purchasers of a regular home have what is called a “fee simple” ownership, meaning they own both the house and the land on which it is built. Condo owners do not individually own any land. The land is owned by the owners’ association of which you are a member. A regular homeowner is in full control of his property whereas, with the condo, there are many, many rules and regulations which will be separately covered. 

Co-ownership is what you get when you buy a condo. You immediately become a co-owner with all the other unit owners for what is called “common areas”. There are different types of common areas – “general common areas”, “limited common areas” and “exclusive common areas”.

  1. “General common areas” are used by all the co-owners, e.g. stairways, elevators, hallways, lobbies and amenities like pools.
  2. “Limited common areas” give access to only some co-owners, e.g. because of where a patio is situated, access might be limited to co-owners of a certain floor only.
  3. “Exclusive common areas” are used by individual co-owners for a space designated to one unit, e.g. a balcony or parking space. Condo owners must contribute to the upkeep of the common areas by way of a monthly charge called a condo fee. This item is fully explored under its own heading.

WHAT IS THE DIFFERENCE BETWEEN A CONDOMINIUM AND A TOWNHOME?

Like the condominium, a townhouse is an attached unit, meaning it is attached to another unit, if not on both sides definitely at least on one side. It will have at least two levels going up to five levels in some instances and are generally much bigger than condominiums. 

Ownership, however, includes both the interior and exterior of the building and falls under the “fee simple” ownership type, whereas the “condo” ownership is solely for the interior.

Still, there are some fees involved – Homeowners’ Association fees (HOA) – but they are usually much lower than those of a condo.

Some townhome complexes offer similar amenities as can be found in condo buildings, e.g. pools, gyms, etc.

CONDO DOCS

Reference was made to the Virginia Condominium Act in the first paragraph of this report. With that as a basis, all condominium complexes in Arlington VA must have Articles of Association and Bylaws plus the Governing Documents comprising covenants, Rules and Regulations as well as Financials and certain Board Minutes and amendments to Bylaws and details of insurance policies. 

Details of any Special Assessments will be found in these documents, whether in the minutes of Board Meetings or in the financials themselves.

If you are purchasing a condo, this is where your title or escrow company will find information on any amounts owed by the seller directly, as well as delinquencies and special assessments pertaining to the complex as a whole. This makes it imperative to have a good title company in case you miss these items. 

You will also find information on “Do’s” and “Don’ts” under the House Rules and Regulations in addition to amenities and the like.

Make sure you look them over to determine if there is something in them that you cannot live with. If this is the case, you will be able to use them to get out of your contract so long as you act within the stated contingency period. 

Your Realtor should be keeping track of these important timelines. 

So, please do not underestimate the importance of the Condo Docs. Make sure they are ordered by your realtor in a timely manner and when received by you, read them

in the required timeframe!

CONDO FEES

All condos in Arlington VA have condo fees. As outlined earlier on, there are shared spaces and amenities. Someone has to pay for their upkeep and that’s the purpose of the condo fees. Roofs have to be replaced. Elevators, heating and air equipment, exercise room equipment, carpets, draperies. Gardens and pools need constant care. Snow and refuse removal. These are but a few of the areas of expenditure for condo fees. Consult the financial statements of your condominium for details.

In addition, well-run condominiums in Arlington VA will have reserve funds where part of the monthly fees is set aside to handle future renovations and capital items replacement.

It is natural to be drawn to the lowest condo fee, but this is not necessarily advantageous.

You must dig deeper into the financials of the unit owners’ association to understand how these fees are being spent and if they are even adequate. Low fees can mean that some items are not being taken care of, for instance leading to the dreaded special assessments. 

If it’s an amenity-rich condo complex, it goes without saying that the fees are going to be on the high side. Secondly, the larger the unit, the higher the fee since calculations for each individual unit is based on square footage.

Are you interested in a pool? Are you interested in the gym?If you are not, then perhaps you should be looking at a complex that do not offer these amenities so that you are not paying for something that you will never use. 

There are serious consequences for not paying your condo fees. In a well-run condo complex, the unit owners’ association has broad powers for enforcing collection, including filing for foreclosure.

CONDO MANAGEMENT

All condominiums have a management element in place. Depending on the size of the condo complex or building, this could be a large management company offering its services to many other condominiums, or it could be a small staff employed directly by the unit owners’ association.

Big or small, the purpose is to oversee and take care of the common areas of the condo building.

How the building is cared for is a reflection on the management and can be a red flag that should not go unheeded when making a condo purchase in Arlington VA. How is the complex being managed? Is it a reputable management company with a sterling track record?

This can have a great impact on the enjoyment or otherwise of your home and its resale value. Therefore, take your due diligence seriously.

Remember, you are paying through your monthly fees for the management of the condo complex. Make sure you are getting your monies worth.

INSURANCE FOR YOUR ARLINGTON VA CONDO

Getting insurance on your condo in Arlington Virginia is slightly different than a traditional homeowner's policy. Are you one of those people who think that you do not need individual insurance because you are covered by the Condo Association’s policy? Whether or not, let’s talk.

It is good to remember that you own the area within your unit, therefore you are responsible for the contents/personal property and any pipes that do not emanate from outside. Also, there is no question that you and you alone will be responsible for your personal property. As to other damage, your liability will be defined in the Governing Documents of the association.

The Governing Docs could state that the Association is only responsible based on the original cost of whatever was damaged so that if you had undergone major renovations, you would not be reimbursed based on the renovated value, thus leaving a big gap for you to fill; hence the need for your own insurance.

In the case of water damage, if the water intrusion was as a result of a malfunctioning appliance or whatever from a neighbor unless that neighbor was negligent, you would still be responsible for the damage – again, hence the need for your own flood insurance.  If the building has taken water, the common areas will be usually be covered by the flood insurance policy held by the condo association. 

Please also note that you will always be responsible for the Association’s deductible whenever a claim is made under the Association’s policy due to your negligence.

Most Associations have “single-entity” coverage, which like bare walls coverage insures the general and limited common elements. This coverage also extends within individual units to fixtures, appliances, walls, floor coverings, and cabinetry, but only for like kind and quality to that conveyed by the developer to the original owner.

WHAT IS PROPER INSURANCE IF YOU OWN A CONDO IN ARLINGTON VA?

To be properly insured as the owner of a condo in Arlington VA, you should seek out and obtain a HO-6 individual homeowner's policy.

It will provide coverage for personal property, unit improvements, betterments, additions and alterations, additional living expenses and personal liability. You should also obtain a copy of your Association’s Master Policy Declaration Page to supply your insurance agent to ensure that the correct amount relative to the Master Policy deductible is included in your individual policy.

As you can see, being properly insured when you own a condominium in Arlington VA is somewhat complicated and should be dealt with as such prior to an incident.

RULES AND REGULATIONS FOR CONDOS

If you live in a condo in Arlington VA, you are going to be subject to some rules and regulations. Be conversant with them and make sure they are acceptable to you.

SPECIAL ASSESSMENTS FOR CONDOS IN ARLINGTON VA

Condo Special Assessments – these three words are generally greeted with dread, apprehension and even suspicion in some instances. But is such a feeling warranted? Let’s step back for a minute.

You are already familiar with condo fees whether or not you actually live in a condo. And it is generally understood that condo fees are assessed to cover upkeep and maintenance of the “common areas” (the areas that are shared with the other co-owners of the building) and general management of the building, be it through an outside management company or onsite staff.

Then out of the blue you might receive a notice from your Association that you are being assessed $$ to cover the cost of something – roof replacement perhaps, replacement of carpets, whatever. 

You are not pleased. How did this come about you ask? It’s a large amount of money – where

am I to get the funds from? Bottom line, you are not prepared for this bit of news. After all, you have been paying your monthly condo fees.

SPECIAL ASSESSMENTS SHOULD NOT COME AS A SURPRISE

First off. This kind of surprise notification is more likely to happen in a less-than-well-run condo community. With these types of communities, there are usually not regularly scheduled Board Meetings due to lack of participation from the co-owners. Therefore, the result is that there is no one keeping an eye on the financials per recommended best practices as well as future planning. In other words, communities of this sort are being run condo fee to condo fee (in line with how some people live from paycheck to paycheck). 

Regardless, you are obligated to pay this assessment since it is covered in the Bylaws of the Association. Special assessments should never come as a surprise. If they come at all, that should occur only after discussion at several board meetings followed by a vote which has been passed by the necessary majority of co-owners. Then such decision and details should be distributed to all unit owners.

WHAT ARE SPECIAL ASSESSMENTS ANYWAY?

Special assessments are assessments against each co-owner of a condo unit over and above the assessed monthly condo fee. They become necessary when there are no reserves or insufficient reserves (funds put away out of the monthly condo fees) to cover one-off, major items of expenditure, e.g. replacement of an elevator or roof, air-conditioning equipment, carpet replacement. These are usually large amounts required to be paid fairly quickly.

HOW ARE SPECIAL ASSESSMENTS PAID?

Many times, the amount assessed is requested in a lump sum. Other times, arrangements are made to spread it over a period, e.g. six months or twelve months. In such a case, the extra amount is added on to the monthly condo fee for the agreed period, after which the condo fee reverts to its regular amount.

HOW CAN SPECIAL ASSESSMENTS BE AVOIDED?

Special assessments can be avoided with good planning. This can only occur with an engaged Board of Directors and Association working in con-cert with all co-owners.

An ideal way is to have committees of co-owners for each major area of expenditure, e.g. Building Maintenance, Facilities Maintenance, Landscape & Grounds, Reserve Fund Planning.

These committees will constantly be overseeing their respective areas, reporting back to the Board at each monthly meeting. Initially there will be a study for each major item and its life expectancy and anticipated replacement cost.

Based on those studies, a determination can be made as to whether or not the reserves being set aside from current condo fees will be sufficient to take care of a specific item at the planned time.

If it is not, then the condo fees can be adjusted accordingly and/or a special assessment spread

over a longer period.

When you are in a poorly run condo complex and most of the co-owners simply ignore the special assessment notice, serious problems are going to arise.

Not surprising, since these complexes would have already been plagued by high delinquencies in their condo fee collections. People have been known to just walk away.

This is not hard to do where the “buy-in” was minimal or non-existent, e.g. where the co-owner had taken advantage of a special program allowing purchase with no money down or having it (the down payment) and the closing costs rolled into the mortgage. Meaning that purchaser had no “skin in the game”.

You are now, therefore, in a condo complex unable to sustain itself – the market is saturated with numerous units being put on the market at fire sale prices with no takers.

Bottom line, the moral of the story is that due diligence is critical when purchasing a condo, as well as the expertise of an experienced Arlington VA Realtor.

Once you become a resident of a condo complex, you should endeavor to be involved or at least keep abreast of, and read, all communication from the unit owners’ association. You have a vested interest. Pay attention – let your voice be heard.

HOW DO I BUY A CONDO IN ARLINGTON VA?

Purchasing a condo can be just as stressful as buying a regular home, so make sure you have absorbed the general information in this guide fully. Now it’s time to enter the real buying process that every purchaser of real estate goes through.

Were you planning on this goal for some time and, therefore, have funds set aside?

Your first act will be to contact a real estate agent. He or she will broach this topic by asking if you have a pre-approval letter assuming you are not going to be a cash purchaser.

Assuming that you are not a cash purchaser, you will be asked to contact a lender or given referrals to some.

This lender will request certain information from you including :

• Your income

• Your expenses

• Your credit score

• Your employer

• Your length of employment

• Are you an employee or are you self employed

• (Self-employment must be for at least two years

with proper documentation to support the incomes)

• Tax Returns (2 years)

• W-2s (2 years)

• 30 days recent pay stubs

• 60 days recent bank statements

• Last quarter’s worth of savings accounts

  and investment accounts statements

• Clear and legible copy of a photo ID

Using this information (with your approval to verify same), the lender will be able to come back with a pre-approval letter stating the maximum amount that they will consider lending.

Where issues come to light and a pre-approval letter cannot be given, the lender will offer assistance in getting the discrepancies cleared up, if possible. In some instances, your home purchase will have to be delayed for quite a while, but a good lender (as well as the real estate agent) will stay in touch.

Now, with pre-approval letter in hand, you are ready to consult with the realtor. Here, your needs and wants are going to be highlighted – type of condo (hi rise or other), size, location, etc. The pre-approval letter will state the type of financing which the lender would have already discussed with you.

Still, it needs to be pointed out that if FHA financing is going to be used, the building itself comes into play as well. Together, you will come up with a list of criteria and based on that, the realtor will be able to identify suitable condos for your perusal online.

You will decide which ones you would like to see and the Realtor will arrange the viewings. 

So off you go for the fun part of buying a condo in Arlington Virginia, i.e. actually looking at

them and choosing the one.

Your Realtor will take over here and prepare the offer documents with your input. He or she should have already gone over the main document with you – the Purchase Contract – so you should not be seeing it for the first time.

It will state your agreed offer price, your down payment, among other things. You will be asked for a copy of a check payable to the title and escrow company for the amount of the earnest money. (This is the amount that must accompany any contract – the consideration – to make it valid. It can be any amount, but is usually determined by what is appropriate for your market and the price of the home being purchased).

When your offer is accepted by the seller, the contract will be noted as ratified. (Please note that sometimes offers are not accepted despite good faith negotiations between the buyer and seller).

This is a happy time. You are half-way to owning your dream home! Still, caution needs to be

exercised here. Many contracts fall out during this escrow period. First order of business is to

mail the earnest money check to the title company.

It is during this escrow period that your realtor makes his or her commission. There are many parties involved – buyer, seller, buyer agent, seller agent, lender, inspector, appraiser, title company to name a few. Many deadlines are in play and it is your realtor’s responsibility to see

that these deadlines are met.

You will be asked to attend the inspection of your condo. You will be given copies of the condo docs. You will be asked to obtain a Homeowners’ Insurance Policy. You must deal with these in the stated timeframes.

It is during this period that requests for repairs can be made and dealt with. It can be quite a juggling act.

You will also be cautioned by your lender not to make any big purchases, especially on your credit card; not to change jobs. You will be asked to verify the information already given and sometimes asked for more information before the loan is finally approved.

Finally, it is closing day. You would have been advised by the lender and the title company what to take to the closing – certified check for the balance of your down payment and closing costs, picture ID.

Some realtors do not attend the closings with their clients. I certainly do. The seller may or may not be there. They could be closing with their own title company.

You will be asked for the check for the balance of the funds to be paid by you. You will be asked to sign a mound of documents, including the Deed and Promissory Note.

You will receive copies of all of these to take with you. Within a couple of weeks, you will get the original Deed in the mail from the County Office after it has been Registered.

And you are given the keys to your condo!

BON AIR MEMORIAL ROSE GARDEN PARK

Bon Air Park features a beautiful memorial rose garden that is often a chosen location for wedding photos. The Arlington Rose Foundation serves as partner to advise on and help promote planting. Enjoy the azalea, shade, sun and ornamental tree gardens. Master Gardeners of Arlington maintain sun and shade gardens to use as teaching tools for local gardeners.

MOUNT VERNON TRAIL

The Mount Vernon Trail runs parallel to the George Washington Memorial Parkway and follows the west bank of the Potomac River from Theodore Roosevelt Island to George Washington’s Mount Vernon Estate. The paved multi-use recreation trail is nearly 18 miles long and is a favorite of area cyclists and runners. The trail offers wonderful views of the Potomac River and Washington DC’s famous landmarks.

The terrain on the Mount Vernon Trail is fairly flat and an easy bike ride. The path passes though Old Town Alexandria where it requires riding on the street with vehicle traffic. At the northern end at Roosevelt Island, you can cross the footbridge and head west on the Custis Trail which connects to the W&OD Trail, a 45 mile rail trail through Northern Virginia. South of the Woodrow Wilson Bridge, the last mile has a pretty good climb heading toward Mount Vernon.

NETHERLANDS CARILLON AND PARK

Location: The Netherlands Carillon is located in Arlington, Virginia adjacent to the Iwo Jima Memorial. The closest Metro station is Rosslyn.

The Netherlands Carillon is a bell tower near Washington, DC that was given to America as an expression of gratitude from the Dutch people for aid provided during and after World War II. The carillon plays recorded music that is programmed to play automatically by computer. Its fifty bells give it two notes more than four octaves. Winchester Chimes play daily on the hour between 10:00 a.m. and 6:00 p.m. Other patriot tunes are played at various times. Special concerts are presented on Saturdays and national holidays from May through September. The Netherlands Carillon has nice grassy grounds and offers a wonderful panoramic view of Washington, DC. During concerts, you can climb the tower and view the city from above.

POTOMAC OVERLOOK REGIONAL PARK

Ballston Common Mall (recently closed for major renovations) which originally opened as Parkington Shopping Center in 1951, was one of the first major suburban shopping centers in the Washington D.C. area. It was the first shopping center built around a multi-story parking garage in the United States.

It was located at the intersection of Glebe Road (Virginia State Route 120) and Wilson Boulevard in the Ballston neighborhood of Arlington, Virginia, two blocks from Ballston-MU Station on the Washington Metro’s Orange Line. The Ballston Common mall opened on October 20, 1986, and was a $40 million replacement for the Parkington Shopping Center. The 530,000-square-foot (49,000 m2) center was developed in a limited partnership with the May Centers, a subsidiary of the May Company who, at the time, also owned one of the anchors, Hecht’s.
